In a historic move, South Africa has formally lodged proceedings against Israel at the International Court of Justice (ICJ), marking the first instance of a country launching ICC proceedings against Israel after severing diplomatic ties.

The press release, issued on December 29, 2023, discloses that South Africa has applied to the ICJ, the principal judicial organ of the United Nations, citing alleged violations by Israel of its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide. The focus of these allegations is on the treatment of Palestinians in the Gaza Strip.

The application contends that Israel's actions are "genocidal in character," accusing the nation of specific intent to destroy Palestinians in Gaza within the broader context of the Palestinian national, racial, and ethnic group. South Africa seeks to establish the court's jurisdiction based on Article 36, paragraph 1, of the Statute of the Court and Article IX of the Genocide Convention, to which both South Africa and Israel are parties.

Notably, the application includes a request for provisional measures, invoking Article 41 of the Statute of the Court and Articles 73, 74, and 75 of the Rules of Court. South Africa urges the court to indicate provisional measures to "protect against further, severe, and irreparable harm to the rights of the Palestinian people under the Genocide Convention" and to ensure Israel's compliance with its obligations to prevent and punish genocide.
